Orange County, California Domestic Partnership Attorney

In California to commence a divorce, a legal separation or to end a domestic partnership, a Petition for Dissolution, which is a lawsuit, is filed. Although dissolution is considered “no-fault” one has to state legal grounds, usually irreconcilable differences. Once the Summons and Petition are served on the other spouse who has thirty days to file their Response.

After the Response is served “temporary orders” may be made in order to maintain the custodial status quo, obtain financial support, exclusive use of home or business. These temporary orders can be agreed upon by stipulation or Court ordered after a noticed hearing.

Throughout the dissolution both parties have a fiduciary duty to disclose all their financial dealings to one another until the final court determination. The process for exchanging and obtaining information is known as discovery. Oftentimes parties will reach a settlement after they have exchanged all the pertinent financial information. If the parties cannot reach a settlement outside of Court, there will be a trial.

Agreements: Any signed Premarital, Post-marital or Cohabitation Agreement is necessary as it defines and may limit your rights.

Custody: Records relating to custody vary. The children’s school records, a spouse’s criminal history, domestic violence or drug and alcohol abuse would be important in some cases where it’s at issue.
