Orange County Domestic Partnership Attorney

In California to commence a divorce, a legal separation or to end a domestic partnership, a Petition for Dissolution, which is a lawsuit, is filed. Although dissolution is considered "no-fault" one has to state legal grounds, usually irreconcilable differences. Once the Summons and Petition are served on the other spouse who has thirty days to file their Response.

After the Response is served "temporary orders" may be made in order to maintain the custodial status quo, obtain financial support, exclusive use of home or business. These temporary orders can be agreed upon by stipulation or Court ordered after a noticed hearing.

Throughout the dissolution both parties have a fiduciary duty to disclose all their financial dealings to one another until the final court determination. The process for exchanging and obtaining information is known as discovery. Oftentimes parties will reach a settlement after they have exchanged all the pertinent financial information. If the parties cannot reach a settlement outside of Court, there will be a trial.

Initial Consultation

At our initial meeting we will be prepared to discuss your issues fully with our experienced lawyer. Supporting documents will greatly assist us in evaluating your situation as quickly as possible and formulating our strategy. The types of documents needed depend on the kind of family law matter you have.

Financial records: Tax returns, bank statements, money market account statements, corporate books, profit and loss statements, pension statements, and credit card statements, promissory notes, to name a few.

Real Property: If you own real property whether situated in California or outside, copies of deeds of trust, lease contracts, appraisals and mortgage statements would be needed.

Agreements: Any signed Premarital, Post-marital or Cohabitation Agreement is necessary as it defines and may limit your rights.

Custody: Records relating to custody vary. The children's school records, a spouse's criminal history, domestic violence or drug and alcohol abuse would be important in some cases where it's at issue.

Domestic Violence can occur in or out of the context of a marriage. Family law courts have a designated court and mediation process to assist the parties and the court in determining what orders are appropriate. If domestic violence occurs during the dissolution, it will be handled by the same judge that is assigned to the divorce. The finding of domestic violence has serious consequences affecting child custody, high security clearance in employment, contact with children and possible dependency proceedings.
